Next Level Soul, Inc. (hereinafter referred to as "Next Level Soul") is an online service provider as defined in the Digital Millennium Copyright Act (DMCA). We provide legal copyright owners with the ability to self-publish content on the internet by uploading, storing, and displaying various media utilizing our services.
Next Level Soul does not monitor, screen, or review the media uploaded to our servers by users of the service. While we strive to uphold intellectual property rights, we rely on copyright holders to inform us when unauthorized content has been published through our platform.
Copyright Infringement & Takedown Notice (DMCA Notice)
We take copyright violations very seriously and are committed to protecting the rights of legal copyright owners. If you are the copyright owner (or an authorized agent acting on behalf of the copyright owner) of content that appears on the Next Level Soul website, including NextLevelSoul.com or NextLevelSoul.tv, and you believe that the content has been used without authorization, you must notify us in writing so that we can investigate the matter and take appropriate action.
In order for Next Level Soul to address your complaint effectively, your DMCA Notice must include the following information:
- Your Contact Information:
- Your full legal name (or the name of the authorized representative).
- Your mailing address.
- Your telephone number.
- Your email address.
- Proof of Ownership:
- A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner who holds the exclusive right that is allegedly infringed.
- Identification of Copyrighted Work:
- Clear identification of the copyrighted work you claim has been infringed.
- If your claim involves multiple works, you must provide a representative list identifying each item.
- Identification of Infringing Content:
- Specific identification of the allegedly infringing material, including the URL(s) or precise location(s) where the content can be found.
- Information sufficient for Next Level Soul to locate the material on our platform.
- Good Faith Statement:
- A statement by you, made under penalty of perjury, that you have a good faith belief that the use of the material complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy & Authorization Statement:
- A statement that the information provided in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
Failure to Provide Complete Information
If you fail to provide all required information in your notice, we may be unable to investigate and address your claim. Please ensure that all information provided is accurate and complete.
DMCA Counter-Notice
If you believe that material you posted on Next Level Soul was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification in accordance with the DMCA. Your counter-notification must include:
- Your full legal name, mailing address, telephone number, and email address.
- Identification of the material that has been removed or disabled, including the URL or location where the content appeared before removal.
- A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled due to mistake or misidentification.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you reside outside the United States, you consent to jurisdiction in any judicial district where Next Level Soul operates).
- A statement that you will accept service of process from the party who filed the DMCA notice or an agent of that party.
Fair Use Notice
Under 17 U.S. Code § 107 – Limitations on Exclusive Rights (Fair Use), certain uses of copyrighted materials may qualify as fair use. This includes use for purposes such as:
- Criticism
- Comment
- News reporting
- Teaching, including multiple copies for classroom use
- Scholarship
- Research
When determining whether a particular use is considered fair use, the following factors will be evaluated:
- Purpose and Character of Use: Whether the use is for commercial gain or for nonprofit educational purposes.
- Nature of the Copyrighted Work: Whether the original content is factual, creative, or published.
- Amount and Substantiality: The quantity and significance of the portion used relative to the copyrighted work as a whole.
- Effect on the Market: Whether the use negatively impacts the original work’s value or market potential.
The fact that a work is unpublished does not automatically preclude a finding of fair use if such use meets the above criteria.
The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.

By using Next Level Soul and its associated services, you acknowledge that you understand and agree to this DMCA Policy. You understand that filing false claims or knowingly misrepresenting content as infringing may result in legal consequences under Section 512(f) of the DMCA.
